Prosecutor Suspended: The Battle Over Poland’s Constitutional Order
A coup probe shakes Poland’s government: Donald Tusk and top officials stand accused, while Prosecutor Ostrowski is suspended for pursuing the case. Tensions soar amid fears of deeper turmoil
In our last post, we informed you that the President of the Constitutional Tribunal—the most important Polish judicial institution—filed a notification regarding the suspicion of a coup d'état committed by, among others, Prime Minister Donald Tusk, the Marshals of the Sejm and Senate, the head of the Government Legislation Centre, and some judges and prosecutors. The notification was received by the Deputy Prosecutor General, Prosecutor Michał Ostrowski, who initiated an investigation. For several days, there were messages from Donald Tusk's camp that they considered this investigation invalid, frivolous, etc. The spokesperson for the Prosecutor General (and, at the same time, Minister of Justice Adam Bodnar) tried some tricks at the conference, explaining that there were some technical errors, a missing number, etc., and that the investigation could not be conducted. This turned out to be complete nonsense, and Prosecutor Ostrowski conducted the investigation and carried out subsequent activities in accordance with the law. Tusk finally dropped the easy-going message that “calm down, nothing is happening, this investigation is childish, and I’m playing ping-pong,” and today, as reported by journalists from TV Republika, Adam Bodnar suspended Prosecutor Ostrowski, preventing him from taking further action. What’s more, in a typically totalitarian manner, charges were brought against the prosecutor who dared to do his job... A drama is unfolding before our eyes that could break the spine of the Polish justice system and lead to gigantic social unrest.

First Details of the Investigation Revealed
On Thursday, February 6, at a press conference, Prosecutor Ostrowski revealed the first information on the course of the investigation. Ostrowski said that after initiating the investigation into the systemic coup d'état and the use of force to influence constitutional bodies, he had collected the appropriate documents and drawn up a plan. He also said that he had already questioned, as witnesses, the President of the Constitutional Tribunal, Bogdan Święczkowski, the President of the Supreme Court, Marta Manowska, and the Chairwoman of the National Council of the Judiciary, Dagmara Pawełczyk-Woicka.
During the press briefing, the Prosecutor also said that he had issued an order entrusting investigative activities to the Internal Security Agency—the most important Polish secret service established to protect the internal security of the state and the constitutional order of the Republic of Poland. He added that he hoped it would be carried out.

“I intend to carry out further activities involving witnesses and gather documents. Yesterday, Prosecutor General Adam Bodnar was informed about the investigation—by me, in writing. I cannot provide him with detailed information, because the investigation also concerns his behavior,” assured Prosecutor Michał Ostrowski, and told journalists that “the investigation has been registered in the prosecutor’s office.” This was one of the legal loopholes that Tusk’s side used, claiming there was no such investigation and that it could not be conducted. “I asked the Prosecutor General yesterday to assign a DS number. I am waiting for this decision. There is no other way out here, since there is a decision to initiate evidentiary activities. Such a number must be assigned. This is a completely technical and secondary activity...” he stated.
Mounting Pressure on Prosecutor Ostrowski
Already at the end of last week, Tusk’s “nothing is happening, we don’t care” chant began to melt away when rumors appeared that Prosecutor General/Minister of Justice Adam Bodnar was beginning to put pressure on Prosecutor Ostrowski regarding the case files. Bodnar allegedly demanded that the documents be handed over, but Ostrowski refused, indicating that it would be inappropriate to provide them to the person concerned in the proceedings. Despite this argument, Bodnar did not give in. According to unofficial information from Radio Wnet, which appeared yesterday evening, Prosecutor Ostrowski provided the Prosecutor General, Adam Bodnar, with extensive files regarding the coup d'état case, with the documentation made available only for inspection, without the possibility of taking it over.
Respecting the applicable provisions of the “Prosecutor’s Office Law,” Ostrowski did not question Adam Bodnar’s official authority. At the same time, he demanded that Bodnar immediately return the files after analyzing them, emphasizing that the prosecutor’s authority cannot interfere in ongoing proceedings in a way that violates the standards of the rule of law.

Possible Motives Behind the Suspension
What did Bodnar find in these files? Apart from the aforementioned testimonies of the President of the Constitutional Tribunal, the President of the Supreme Court, and the Chairwoman of the National Council of the Judiciary—the content of which we naturally do not know—Prosecutor Ostrowski has probably already found enough evidence that Tusk/Bodnar decided to kill the case as soon as possible. Let’s face it, the scandalous and illegal actions of Tusk and his team are being carried out brazenly, in broad daylight, under the glare of TV cameras with the slogan “we are allowed this because we defend democracy.” So constructing this case and finding further broken provisions of Polish law is probably quite easy.
Tusk can afford such brazenness because he is convinced that no one in the international/European sphere will spoil his plans in this matter. He has the full support of the German apparatus governing the European Union, and nothing like what happened under the rule of conservatives in Poland will happen. As a reminder, conservative governments tried to reform the Polish justice system legally by changing and introducing laws through the Polish Parliament and were accused of violating the rule of law—procedures were initiated against Poland, European funds were taken away from us, etc. The same methods were used to break Poland in matters such as migration—the so-called case of forced relocation of immigrants, who were once invited to the EU by German Chancellor Angela Merkel. Tusk knows that he can now brutally break the regulations he claimed to defend a dozen or so months ago and that Germany and EU will do nothing. There will be no procedures in European courts on the rule of law... This case will not even make it to the Western media.
Prosecutor’s Suspension and Retaliation
Hence also today’s shockingly brazen decision by Adam Bodnar that Prosecutor Ostrowski has been suspended from performing his duties for a period of six months, which has already been confirmed by the National Prosecutor’s Office. As we learned literally a few hours ago, even that was not enough for Tusk’s people. In typical Soviet fashion, they immediately began to take revenge. “Every provocateur or madman who dares to raise his hand against the people’s government, let him be sure that the people’s government will chop it off”—as the communist prime minister Józef Cyrankiewicz once said. Prosecutor Ostrowski was charged.
“Yesterday, the National Prosecutor’s Office received a notification from Adam Bodnar about a justified suspicion of a crime committed by Prosecutor Michał Ostrowski, formally acting as his deputy. In this notification, Adam Bodnar indicates a suspicion of Michał Ostrowski exceeding his powers. That is, a suspicion of an official crime under Article 231 of the Penal Code. In this justification, he indicates a number of circumstances justifying this suspicion of a crime being committed,” Przemysław Nowak, spokesman for the National Prosecutor’s Office informed during a press conference today.

Reaction from the Constitutional Tribunal
Not yet knowing about the charges against Ostrowski, the President of the Constitutional Tribunal spoke about the matter of his suspension in a statement.
“I received with disbelief and indignation the information about the groundless suspension by the suspected Prosecutor General, Adam Bodnar, of Prosecutor Michał Ostrowski, Deputy Prosecutor General, who was conducting the investigation into the notification I submitted about the justified commission of crimes, and thus preventing him from performing his duties,” stated President Bogdan Święczkowski.
In the opinion of the President of the Constitutional Tribunal, this suspension only confirms the theses he included in the notification.
“The suspension of Prosecutor Michał Ostrowski, Deputy Prosecutor General, is unlawful in nature and constitutes confirmation of the carrying out in the Republic of Poland of actions that have the nature of a systemic coup d'état on the Constitutional Tribunal, the Supreme Court, common courts, the National Council of the Judiciary, the prosecutor’s office, public media, and the National Electoral Commission and the decisions made by these institutions,” stated Święczkowski.
Fears of Escalation
As you can see, the gloves are off in the fight for law in Poland. Tusk’s government is already resorting not only to harassment of the media and illegal arrests of former ministers, but also to violence within the justice system itself. We fear that this will end tragically, because although part of Polish society—seduced by the propaganda of the German media in Poland—blindly supports Tusk, the vast majority will not allow the law to be trampled any further. What will happen then? Will there be arrests, social unrest? Tusk and his supporters, like communists in Poland at one time, completely ignore the consequences, so we fear the worst possible development of the situation in our country in the coming months.
Due to the current dominance of left-liberal media in the US and Western Europe, this information and this perspective have no chance of reaching the public consciousness, which is why we ask—share this text and information as broadly as possible. The only thing that seems to be able to stop Tusk from introducing de facto totalitarianism in Poland is a commotion on the international forum.
